Family Wealth Planning

Business Succession Planning
We help to prepare agreements now that will avoid potentially undesirable succession issues in the future.  In business succession planning, it is critical that property and assets are properly structured so that a transfer of assets will not overwhelm the liquidity available to satisfy estate taxes. Insurance and the preparation of irrevocable life insurance trust is one possible solution. The business can also be transferred over time at discounted values to remove it from the estate’s taxable base.

Structuring the manner in which assets are owned may reduce the risk of liability of exposure to potential creditors.

Estate, Gift Tax, and Generation Skipping Transfer Tax Exemptions, Deductions, and Credits
Our attorneys are well versed in the federal tax exemptions, deductions, and credits that are available to minimize or eliminate tax liability for transfers both during one’s life and upon death. We also help our clients plan the transfer of wealth in such a way as to maximize these benefits such as maximizing the use of martial credits, annual exclusions, charitable deductions, and the unified credit.

Lifetime Transfers & Gifts
Our attorneys can advise clients and help structure transfers and gifts of property during the client’s life. Transferring property during one’s lifetime often has many advantages including protecting assets and reducing or eliminating tax liability that may otherwise be incurred if those assets were transferred by inheritance or as directed by the client’s will and even eliminating tax on future appreciation of assets. Additionally, since gift taxes are usually much more favorable than estate taxes, transferring property during one’s life, even if that transfer is subject to gift tax, usually will save that individual significant tax liability that otherwise may arise. We use many techniques and estate planning vehicles to help clients transfer assets to others while in some instances retaining the use of those assets and minimizing current and future tax consequences. Some of these techniques include using trusts such as Qualified Personal Residence Trusts, Grantor Retained Annuity and Unitrusts, and charitable trusts such as Charitable Lead Annuity and Unitrusts. Furthermore, since Yesner & Boss, P.L. is a licensed title agency as well we can facilitate any transfers quickly and easily while saving the client significant costs.

Probate and Trust Administration
Our attorneys provide advice to fiduciaries with the goal of avoiding suits or, in certain circumstances, of instigating legal action to protect the interests of the heir and/or beneficiary.  Managing an estate or trust requires not only good intentions, but also strict adherence to often complex laws and regulations.
